Welcome to the AMAN app.
Please read these Terms and Conditions carefully before using the services of the AMAN app.
The terms and conditions set out in this document (the "Agreement") constitute the complete legal agreement between "AMAN" — referred to as the "App", the "AMAN App" or the "Service" — and the users of the App ("Service Providers", "Customers"). Please read these Terms of Use carefully and make sure you know and understand them before you start using AMAN's services.
Your visit to and use of the AMAN app constitutes your confirmation that you accept these Terms of Use and agree to be bound by them. If you do not agree to these Terms of Use, you must not use our app.
These Terms and Conditions apply to your use of the AMAN app. Your visit to and use of AMAN's services means you agree to comply with these Terms and Conditions. If you do not agree to them, you must not use the App. We reserve the right, at our sole discretion, to change the Terms and Conditions from time to time, so you should review them periodically. We are not obliged to contact, inform or alert you about any changes made to the Terms and Conditions. Your continued use of the AMAN app and its services constitutes your express acceptance of the Terms and Conditions in force at the time of your use.
Service Description
"AMAN" is an electronic application owned by AMAN Rental Company. It is an online platform that acts as an intermediary between service providers and the customers who use the App, allowing service providers to communicate with customers and provide services to them according to what is available within the App.
Definitions
In this Agreement, unless the context requires otherwise, the following terms have the meanings indicated:
"AMAN", the "App", the "Administration", "we", "us" or "our": refer to the AMAN trademark and the company's legal name (AMAN Rental Company).
"Account": the space allocated to you in the App that enables you to benefit from AMAN's services.
"User" / "you" / "your": any person who creates an account, uses the App or is active on the App.
"Service Provider": those who deliver the services available on the App (delivery representatives), approved by the App's executive management or the App owner.
"Customer": the person requesting the service and using the App.
"Content": all videos, audio, text, graphics, images and any other material entered into, processed by, included in or accessed through the App.
"Services": the rental of wheelchairs for the elderly, people of determination and people with limited mobility, or any other service provided through the AMAN app.
"Agreement": this document and the terms and conditions it contains, together with the Privacy Policy and all supplementary agreements and policies implementing your agreement with us.
General Provisions
Your access to and use of the App or the Services is conditional on your agreement to the following:
You will comply with all applicable laws and regulations when using the App or the Services.
You have the legal capacity to enter into this Agreement with us and are 18 years of age or older to access and use the AMAN app. If you are a minor (under the specified age), you may use the App's services under the supervision of a parent or legal guardian, provided you agree to abide by these Terms of Use.
You agree to use the App or the Services only for your own personal, internal purposes.
You will not copy, reproduce, download, republish, sell or distribute any services, information, text, images, graphics, videos, audio, files, databases, lists or similar material available on or through the App ("App Content"), and you will not copy, reproduce, download, compile or otherwise use any App Content to operate a business that competes with the AMAN app, or otherwise exploit the App Content commercially. Using any content or material on the App for any purpose not expressly permitted in these Terms is prohibited.
Membership
Subscription and membership in the AMAN app are free of charge, and we reserve the right to introduce fees in the future if we consider it necessary.
Registration and Account Use
To benefit from our services in the AMAN app you must create a valid account with us. By registering as a customer or a service provider (delivery representative) on the AMAN app, you acknowledge and agree to these Terms and Conditions — including the Privacy Policy, which is an integral part of them — and to the regulations of the country in which the App operates. Your access to and entry into the App constitutes your express acceptance of the Terms of Use, whether you are a registered user or a visitor, and this Agreement applies from the date of your first use of the App.
You must provide complete, correct and accurate information — your name, phone number, email address and any other data requested from you.
The service provider (delivery representative) undertakes to submit all papers and documents required to prove their identity upon registration. The AMAN app administration has the right to take the legal measures available to it to examine its users' accounts and to request additional information or documents to verify their identity when needed.
You are responsible for reviewing that information periodically and correcting, amending or updating it whenever new information becomes available, and you are fully responsible for any unreliability of, or error in, this data.
You are responsible for keeping your account information confidential, and you are responsible for any disclosure of it to others and for any use by anyone to whom it has been disclosed.
You must use the App for the purposes it was designed for, and avoid misusing it by placing service requests without need or causing harm to the App or the service provider.
You may not create more than one account in the App with the same mobile number or email address.
You must not be someone who previously benefited from AMAN's services and was banned or blocked from using the App.
We have the right to freeze or cancel violating accounts without any liability if we have reason to suspect that you have registered or are controlling two or more accounts at the same time.
You agree that all activities occurring under your account are authorized by you and of your own free will, that you bear responsibility for any risks arising from using this type of service, and that you will provide us with all documents required to prove your identity.
We have the right to refuse to provide any service or any use of the App without giving reasons.
You are responsible for all losses, damages and expenses resulting from your failure to comply with the provisions of this Agreement or from your negligence.
Under no circumstances will we be liable for direct or indirect damages resulting from using, or being unable to use, the App, or from any error or omission in the use of the App's content and functions.
We accept no responsibility for anything arising from any delay or cancellation of an order, any failure to complete a service, or any miscommunication between the customer and the service provider (delivery representative).
You undertake to inform us immediately of any breach, theft or discovered unlawful use of your account on the App, so that we can take the technical measures necessary to protect the account.
Any addition, amendment or update to these Terms and Conditions takes effect as soon as it is announced, unless otherwise indicated, and your continued use of the App after any addition or amendment is announced constitutes full acceptance of those changes.
The AMAN app is designed to the highest security standards to protect AMAN's users and prevent any attempts at unlawful access to the system. We accept no responsibility for any loss of data occurring beyond our control due to technical problems, cyber attacks, natural disasters or other causes.
We may, at our sole discretion, ban or cancel accounts that violate the App's terms without referring back to the user or notifying them.
The user acknowledges immediate compliance with these Terms and Conditions, as well as any supplementary terms and conditions specific to each service.
Prohibited Uses
All users — service providers (delivery representatives) and customers — are prohibited from the following:
Using the App, or any service it provides, in an unlawful or fraudulent manner, or to breach any applicable local or international laws, regulations or customary rules, or as we may determine.
Using the App, the Service or the Content in any way that, at our sole discretion, damages our reputation or our brand.
Using the App to infringe or violate intellectual property rights belonging to us or to others.
Publishing any content or messages involving racial discrimination, or discrimination on the basis of religion, ethnicity, age, national origin or disability, or containing insults, defamation, profanity, harassment or abuse, or contradicting the teachings of Islam or public morals.
Limitation of Liability
Service providers (delivery representatives) and customers each agree to the following:
To use the AMAN app at their own responsibility.
To bear full responsibility for all posts and comments published through their account on the App.
To compensate AMAN for any losses or damages resulting from non-compliance with these Terms and Conditions or from their violation of them.
To compensate AMAN for any losses, damages or defects resulting from misuse of the rented products (whether wheelchairs or any other products rented through the App).
To release the AMAN app from any liability for any use of content placed, stored or uploaded by them or by any third party, or for any loss of, or damage to, user content.
The AMAN app administration has the right, at its sole discretion, to monitor, review or otherwise access some or all user content; if it does so, it assumes no additional obligations or liabilities.
The AMAN app administration has the right, at any time and without needing to give you notice, to remove or amend any user content within the App, for any reason, without bearing any liability toward you.
Service providers (delivery representatives) bear the responsibilities and obligations arising from performing services through the AMAN app, and they are liable toward the customers using the App for any damages they suffer as a result of any shortcoming or error related to the performance of the service.
The AMAN app administration has the right to reject service providers (delivery representatives) from using the App and providing services through it, without needing to state the reasons for that rejection.
The customer undertakes to sign the wheelchair-condition form provided by the service provider (delivery representative), which documents the condition of the wheelchair at the time of receipt, and undertakes to return the wheelchair in the same condition described in the form. If the wheelchair's condition differs from what is described in the form, the customer bears all costs of any losses, damages or defects resulting from misuse.
If the rental period ends and the customer has not extended the rental, the administration has the right to fine the customer for the hours of delay and to charge them all fees and expenses determined by the administration.
The customer has the right to rate the service provider's performance and comment on it, and the App may publish and display this rating and comment to all service requesters in a manner that does not conflict with public morals and regulations. We also have the right to take whatever action we deem appropriate based on the rating results, up to suspending the service provider's services or deactivating them entirely.
The service provider (delivery representative) is responsible for the quality of all services they provide in the App.
We make reasonable efforts to ensure that all transactions are processed in a timely manner; however, the AMAN app makes no commitment regarding the amount of time needed to complete the processing of any particular transaction, and it will not be liable for any direct or indirect loss resulting from any such delay.
Disclaimer
We provide our services "as is" and "as available". The platform only connects us with users through service providers (delivery representatives), without any representations or warranties of any kind, whether express or implied, relating to the use of the AMAN app, its content or the services provided on it.
Responsibility for using or relying on the information a user receives or obtains through the App rests with both the people who provide that information and the people who use it.
We are not liable to you or to anyone else for any loss caused by a matter beyond our control. This includes the failure of electronic or mechanical equipment or communication lines (including telephone and internet), unauthorized access, malicious code, theft, operating errors, severe or unusual weather (including floods, earthquakes or other acts of God), fire, war, insurrection, terrorist acts, riots, labor disputes or other labor problems, accidents, emergencies, delays, overbooking, cancellations, the death of a head of state, or government action.
We are not liable, in any circumstances, for any direct, indirect or consequential loss resulting from:
- Using, or being unable to use, the App.
- Disclosure of your username and/or password.
- Any error, omission or inaccuracy in the App and/or the App's content.
We do not guarantee or undertake that the App will not be temporarily interrupted by a fault, or that it will be free of problems or errors.
Financial Transactions
All prices are shown in the App for each service, and prices are confirmed for each service before ordering. We bear full responsibility for updating all prices and for the availability of information within the AMAN app, and we may, at our exclusive discretion, change the prices of the services displayed in the App.
The App contains all the information related to the service.
If the customer cancels the order before the service provider (delivery representative) arrives, the customer is entitled to a refund of the amount paid via the same payment method — that is, if payment was made by Visa or any other electronic method, the amount is refunded via the same method within the period determined by the bank or the customer's payment provider. The administration bears no responsibility for delays in refunding the amount, and the customer has no right to hold the administration accountable for the cause of the delay.
If the customer cancels the order after the service provider (delivery representative) has arrived at the customer's location, the customer is entitled to a refund of the rental cost after deducting the delivery charges, taxes, fees and any other expenses determined by the administration. Once the contract has been signed, the customer has no right to claim a refund of the remaining amount when requesting to return the wheelchair before the end of the rental period.
Value Added Tax
- The rental price does not include value added tax.
- The delivery and wheelchair-return price includes value added tax.
- The price of delay hours includes value added tax.
Payment Methods
At the AMAN app we provide the leading payment solutions used within the Kingdom of Saudi Arabia to deliver the best guaranteed, flexible payment experience for our customers' convenience. They will be announced later.
Service Ratings
Any customer may rate the services and their overall experience of using them, and write notes and comments after completing and receiving the service, for the purposes of development and maintaining service quality. A review must not be misleading, offensive or fabricated about any entity.
Ratings are based on an automatic (algorithmic) classification and rating system calculated as the average of all the ratings (stars) given to a provider's services by real customers who have tried those services.
We add all customer ratings under each service provider's name in our app, so that all future customers can see the quality and level of the service provided.
We use these ratings, comments and reviews as we see fit (for example, for marketing, promotion or service development) on the App, on various social media platforms, in special offers, or on other apps or channels owned, hosted or managed by the AMAN app. We also reserve the exclusive right to edit, reject or remove reviews as we see fit.
Intellectual Property Rights
All of the App's contents — including all information, designs, text, logos, images, graphics, audio recordings, button icons, digital content, re-uploaded material, software and data compilations — are the property of the AMAN app and are protected by the laws of the Kingdom of Saudi Arabia and international copyright laws.
You may not alter or delete any copyright, trademark, ownership or publishing rights.
You may not copy the material or content, reproduce it, broadcast it, distribute it, adapt it, use it commercially or create works based on it.
Trademarks
The AMAN app and its associated logos, images, page headers, button icons, text and service names are trademarks and trade designs of the AMAN app. Reproducing our trademarks or trade designs in any media or advertising outlet without our written permission is prohibited.
Advertising
Your membership of and subscription to the AMAN app automatically entitles you to receive messages, special and promotional offers, newsletters or text messages from the App. These messages are used to inform you of any changes, features or new activities added to the App that we believe may interest you. If at any time you decide that you no longer wish to receive such messages, you can disable them by contacting us; in that case, however, we cannot guarantee that you will enjoy our services in full.
External Links
AMAN is not responsible for the quality, content, nature or accuracy of any other website or app that can be reached through any link on the App or on sites connected to it, whether directly or indirectly. As those sites are not subject to our control, we are not responsible for the contents of any website or app linked to the AMAN app, for any link within any related site or app, for any browsing page, or for any changes or updates those sites undergo. Please contact the administrator of the external site or app directly if any problem arises concerning a link.
Severability
The invalidity or unenforceability of any provision of this Agreement does not affect the validity or enforceability of any other provision. Any invalid or unenforceable provision is deemed severed from this Agreement to the extent of its invalidity or unenforceability, and this Agreement shall be interpreted and performed as if it did not include that particular provision, to the extent of its invalidity or unenforceability.
The invalidity or inapplicability of other provisions or terms of this Agreement does not affect any other provision of this Agreement. Where possible, any unenforceable provision of this Agreement will be amended to reflect the original intention of the parties.
If a competent court finds any term or provision of this Agreement invalid, unlawful or unenforceable, this does not affect the other terms or provisions of this Agreement, or the Agreement as a whole; rather, that term or provision shall be amended to the extent the court considers necessary to make it enforceable, and the rights and obligations of the parties shall be interpreted and applied accordingly, preserving to the fullest extent permitted the intentions and agreements of the parties contained herein.
Amendments
We have the right, at any time, to make any amendments or improvements we consider necessary to the AMAN app to increase its effectiveness, and the user shall comply with any directions or instructions the App gives them in this regard.
We reserve the right, at any time and at our absolute discretion, to revise these Terms of Use ("Terms and Conditions") by amending or changing any or all of these terms. Each time you wish to use the AMAN app, you should review these Terms of Use periodically to make sure you understand the terms that apply at that time, and your continued use of the AMAN app constitutes your acceptance of the Terms and Conditions in force at the time of your use.
Indemnity
You acknowledge and agree to indemnify, defend and hold harmless AMAN, its owner, its parent organization and its affiliates, partners, officers, directors, agents, contractors, licensors, service providers and employees against any claim or demand, and they are released from any harm or liability for all claims, obligations, losses, damages, costs and expenses — including legal fees — arising from any breach or violation of these Terms and Conditions by you, or from other damages arising from your use of the AMAN app.
You agree to compensate AMAN for any losses, damages or defects resulting from misuse of the rented products (whether wheelchairs or any other products rented through the App).
Termination
Termination by AMAN: We reserve the right, at our sole discretion, to terminate, restrict or suspend any user's access to or use of the App without notice and for any reason, without stating any reason, or for any conduct that the AMAN administration considers unlawful or harmful to others — including, but not limited to, cases where we reasonably believe that you have violated the usage policy or any other relevant policy, or that you pose a risk or expose us to potential legal risks.
Termination by you: If you are not satisfied with the AMAN app, please let us know by sending an email to the address shown below. The remedy available to you is to stop using the App.
Entire Agreement
The Terms of Service, together with any policies or operating rules published by us on this App or in relation to the Service, constitute the entire agreement and understanding between you as a user and AMAN, govern your use of the Service, and supersede any prior agreements concerning the subject matter of this Agreement, whether written or oral.
If we are unable to enforce any right or provision of these Terms of Service, this shall not be considered a waiver of it.
If any provision of this Agreement is deemed unlawful, invalid or unenforceable, in whole or in part, under any law, that provision — or the relevant part of it — shall, to that extent, be deemed not to form part of this Agreement, without affecting the legality, validity and enforceability of the other provisions contained in this Agreement.
Governing Law and Dispute Resolution
This Agreement ("Terms and Conditions") — and any disputes, claims or disagreements arising from it, or relating to any breach, termination, enforcement, interpretation or validity of it, or to the use of the App or the Service — is governed by the laws and regulations applicable and in force within the Kingdom of Saudi Arabia.
