Welcome to “AMAN” App!

Please read these Terms and Conditions carefully before using “AMAN” App Services.

The Terms and Conditions set forth herein (the “Agreement”) constitute the entire legal Agreement between “AMAN” (the “App”), (“AMAN App”), (the “Service”) and Users of the App (“Service Providers”, “customers”). Please read these Terms of Use carefully and make sure you are aware of and understand them before You start using AMAN Services.

Your visit and use of “AMAN” App constitutes confirmation from You that You accept and abide by these Terms of Use. If You do not agree to these Terms of Use, You shall not use Our App.

These Terms and Conditions apply to Your use of the “AMAN” App. By visiting and using AMAN Services, You agree to be bound by these Terms and Conditions. If You do not agree to the Terms and Conditions, You shall not use the App. We reserve the right, at our sole discretion, to change the Terms and Conditions from time to time, and You shall review these Terms and Conditions periodically. We do not have to contact You, notify You, or alert You of any changes to the Terms and Conditions. Your continued use of the AMAN App and Services constitutes your express acceptance of the Terms and Conditions applicable at the time of Your use of the App.

Service description

“AMAN” is an electronic App owned by AMAN Rental Company. It is an electronic platform that acts as an intermediary between Service Providers and Clients using the App. “AMAN” App allows Service Providers to communicate with Clients using the App and provide Services to them according to what is available within the App.

Definitions

In this Agreement, and unless the context otherwise requires, the following terms shall have the meanings referred to:

“AMAN”, “App”, “Administration”, “We”, “Us” or “Our”: the AMAN Brand and the legal name of the company (AMAN Rental Company)

“Account”: the space allocated to You in the App, which enables You to benefit from “AMAN” Services.

“User/You/Your”: Any person who creates an Account, uses the App, or is active on the App.

“Service Provider”: those who provide the Services available in the App (delivery agents) and approved by the Executive Administration of the App or the Owner of the App.

“Client”: the Service requester who is the User of the App.

“Content”: all video, audio, text, graphics, images, and any other materials entered, processed, included, or accessed via the App.

“Services”: (renting wheelchairs for the elderly, people of determination, and those unable to move) or any Service provided via “AMAN” App.

“Agreement”: refers to this document and its Terms and Conditions, as well as the Privacy Policy, and all agreements and policies supplementing and implementing Your Agreement with Us.

General Provisions

In order to access and use the App or the Services, You agree to:

Comply with all applicable laws and regulations when using the App or the Services.

That You have the necessary legal capacity to enter into this Agreement with Us, and that You are 18 years of age or over to enter, access, and use “AMAN” App. If You are a minor (You have not reached the specified age), You may use the App Services under the supervision of a parent or legal guardian provided that you agree to abide by the terms of the Terms of Use.

To use the App or Services solely for Your own personal purposes.

Not copy, reproduce, download, republish, distribute or sell any Services or any information, text, images, graphics, video, audio, files, databases, or lists, etc. that is available on or via the App (“App Content”), and that you will not copy, reproduce, download, compile or otherwise use any App Content for the purposes of operating a business that competes with AMAN App, or otherwise exploit the Content of the App commercially. The use of any content or materials on the App for any purpose not expressly permitted in the Terms is prohibited.

Membership

Subscription and membership in “AMAN” App are free, and we are entitled to introduce fees in the future if We deem it necessary.

Registering and using the Account

To benefit from Our Services in “AMAN” App, You shall create a valid Account with Us, and thus acknowledge and agree that when You register as a Client or Service Provider (delivery agent) in “AMAN”. You acknowledge and agree to these Terms and Conditions, including the Privacy Policy (which is an integral part of Terms and Conditions) and the regulations of the country in which the App operates. Your access and entry to the App constitute Your express acceptance of the Terms and Conditions of use, whether You are a Registered User or a visitor. This Agreement is effective as of the date of your first use of the App.

To provide complete, true, and accurate information in terms of name, phone number, email, and other data requested from You.

The Service Provider (delivery agent) undertakes and abides to submit all papers and documents required to prove its identity upon registration, and the Administration of “AMAN” is entitled to take the legal measures allowed to it to examine the Accounts of its Users and request additional information or documents to verify their identity when needed.

You are responsible for reviewing that information periodically for the purpose of correcting, amending, or updating it whenever You have new information about it, and You are fully liable to the unreliability of this data or any error in it.

You are responsible for maintaining the confidential information of Your Account, You are liable to any disclosure of this information to others, and any use made by any person to whom such confidential information has been disclosed.

To use the App according to the purposes for which it was designed, and avoid the improper use of the App by making Service requests without actually needing them or harm to the App or the Service Provider.

ou shall not create more than one Account in the App with the same mobile number or email

We are entitled to refuse to provide any Service or use of the App without giving reasons.

You are responsible for all losses, damages, and expenses resulting from your failure to comply with the Terms of this Agreement or arising from Your negligence.

We shall not, under any circumstances, be liable for direct or indirect damages resulting from the use or inability to use the App or error or omissions in the use of the Contents and functions of the App.

We do not bear any responsibility for all the consequences of any delay or cancellation of an order or failure to complete any Service or miscommunication between the Client and the Service Provider (delivery agent).

You undertake to notify us immediately of any hacking or theft, or discovery of any illegal use of Your Account in the App, in order to be able to take the necessary technical procedures to keep the Account.

Any addition, amendment, or update to the terms and conditions herein shall be deemed effective immediately upon its announcement unless otherwise noted, and Your continued use of the App after announcing any addition or amendment shall indicate Your full acceptance of these amendments.

“AMAN” is designed according to the top security standards to protect “AMAN” Users and prevent any attempts of illegal access to the system. We shall not bear any responsibility for any data loss that occurs beyond our control due to technical problems, electronic hacks, natural disasters, etc.

We are entitled, at our sole discretion, to ban or delete Accounts that violate the terms of the App without referring to or notifying the User.

The User acknowledges its immediate compliance with the terms and conditions herein, as well as any subsidiary terms and conditions for each Service.

Banned Uses

All Service Providers Users (delivery agents) and Clients shall be prohibited from the following:

Using the App or any Service provided illegally or fraudulently or to breach any applicable laws, local and international regulations or laws, or existing customary norms, or as in our sole discretion.

Using the App, Service, or Content in any way, at our sole discretion, in a manner that may cause harm to our reputation or brand.

Using the App to infringe or violate our intellectual property rights or others'.

Posting any Content or messages that are racially discriminatory, or may discriminate in religion, race, age, national origin, or disability, or contain insult, slander, profanity, harassment, mistreatment, contrary to the teachings of the Islamic religion, or violating public morals.

Limitation of Liability

Service Providers (delivery agents) and Clients agree to:

Use “AMAN” at their sole liability.

Bear full responsibility for all posts and comments posted by their Account in the App.

Indemnify “AMAN” for any losses or damages resulting from non-compliance with these terms and conditions or due to the violation hereof.

Indemnify “AMAN” for any loss, damage, or harm arising from the misuse of the rental products (whether wheelchairs or any of the products rented via the App)

Exempt “AMAN” from any responsibility for any use of any Content that has been placed, stored, or uploaded by them or by any third party, or for any loss or damage that may be caused to the User Content.

The Administration of “AMAN” is entitled in its sole discretion to monitor, review, or otherwise access some or all of the User Content, however, if it does so, it does not bear any additional obligations or responsibilities.

The Administration of “AMAN” is entitled, at any time and without having to notify You, to remove or modify any User Content within the App for any reason and without bearing any responsibility towards You.

Service Providers (delivery agents) shall bear the responsibilities and obligations arising from their implementation of Services through “AMAN”, and they shall be responsible towards Clients using the App for any damages arising to them as a result of any default or errors that occur due to the implementation of the Service.

The Administration of “AMAN” is entitled to deny Service Providers (delivery agents) to use the App and provide Services via it without having to justify that denial.

The Client undertakes to sign the Chair Condition Form provided by the Service Providers (delivery agents), which shows the condition of the chair at the time of the Client's receipt, and undertakes to deliver the chair the same condition mentioned in the Form. The Client bears all costs for loss or damage or harm resulting from misuse.

In the event that the lease term expires and the Client does not extend the lease, the Administration is entitled to fine the Client for the hours of delay and charge it all fees and expenses determined by the Administration.

The Client is entitled to rate and feedback the performance of the Service Provider, and the App is entitled to publish and display this rating and feedback to all Service applicants in a manner that does not violate public morals and regulations. We are entitled as well to take any action as We deem appropriate based on the results of the rating, which may lead to the suspension or complete termination of the Service Provider's Services.

The Service Provider (delivery agents) undertakes to be responsible for the quality of all Services provided by it within the App.

We exert reasonable efforts to ensure that all transactions are processed in a timely manner, however, “AMAN” shall not be bound by the amount of time required to complete the processing of any particular transaction and shall not be liable as well for any direct or indirect loss arising from any such delay.

Disclaimer of liability

We provide our Services “as they are” and “as available”. We are a platform to connect us with Users via Service Providers (delivery agents) only, without any representations or warranties of any kind, whether explicit or implicit, related to the use of

“AMAN” or its Content or Services.

The use of or reliance on the information received or obtained by the User via the App is the responsibility of both the persons providing it and the persons using it.

We shall not be liable to You or anyone else for any loss arising from a matter over which We have no control. This includes failure of electronic or mechanical equipment or communication lines (including telephone and internet), unauthorized access, ruined codes, theft, operating errors, severe or unusual weather conditions (including floods, earthquakes, or other acts of fate), fire, war, rebellion, terrorism, riot, labor dispute, other labor problems, accident, emergency, delay, overbooking, cancellation, death of a ruler, or an act of government.

We shall not be liable, in any event, for any direct, indirect or consequential loss arising from:

Using or the inability to use the App.

Disclosure of Your User name and/or password.

Any error, omission or inaccuracy of the App and/or App Content.

We do not warrant or guarantee that the App will not be temporarily interrupted due to any malfunction, or that it is devoid of problems or errors.

Financial transactions

All prices appear in the App for each Service and the prices for each Service are approved before ordering. We are fully responsible for updating all prices and providing information within “AMAN”. The prices of the Services that are displayed on the App may be changed based on Our sole decision.

The App contains all the information about the Service.

In the event that the Client cancels the request before the arrival of the Service Provider (delivery agent), the Client is entitled to recover the paid amount in the same method of payment, i.e. in the case of payment by Visa or any electronic means, the amount is returned by the same method of payment within the period specified by the bank or the Client’s payment authority. The Administration does not bear the responsibility for the delay in refunding the amount, and the Client shall not hold the Administration accountable for the delay.

However, in the event that the Client cancels the order after the Service Provider (delivery agent) arrives at the Client’s location, the Client is entitled to recover the rental cost after deducting the delivery expenses, the value of taxes, fees and any other expenses determined by the Administration.

Value-added Tax

The rental price does not include VAT.

The price of delivery and return of the chair includes VAT.

The price of delay hours includes VAT.

Payment methods

We, at “AMAN”, provide the optimal payment solutions used within the Kingdom of Saudi Arabia to provide the best guaranteed and flexible payment experience for the convenience of Clients, which will be announced later.

Service rating

Any Client shall be allowed to rate the Services and their User experience in general and write feedback after completing and obtaining the Service in order to develop and maintain the quality of the Services. This review shall not be misleading, offensive, or false to any entity.

The evaluation is based on an automatic (logarithmic) rating and a rating system that is calculated as an average of all ratings (stars) given to the Services of the Provider from real Clients who have tried those Services.

We add all Client reviews under the name of each Service Provider on our electronic App so that all future Clients know the quality and level of Service provided.

We use such ratings, feedbacks, and reviews as We see fit (for example for marketing, promotion, or development of Services) on the App, various social media sites, special offers, applications, or other channels owned, hosted, or operated by “AMAN”, and We reserve the sole right to modify, reject, or remove reviews as We see fit.

Intellectual property rights

All Content of the App and all information, designs, text, logos, images, graphics, audio recordings, button icons, digital Content, re-downloadable materials, software, and data compilation is the property of “AMAN”, and are protected by the laws of the Kingdom of Saudi Arabia and international copyright laws.

You shall not change or delete any of the intellectual property rights, trademark, proprietary rights, or copyrights.

You shall not copy, reproduce, broadcast, distribute, adapt, commercially use the material or Content, or create works based on it.

Trademarks

“AMAN” and its associated logos, images, page headers, button icons, text, and Service names are trademarks and commercial designs of “AMAN”, and it is prohibited to reproduce our trademarks or commercial designs in any media or advertising without our written permission.

Advertising

Your subscription to “AMAN” automatically entitles You to receive messages, special offers, promotions, mailing bulletins, or text messages from the App. These messages are used to notify You of any changes, features, or new activities added to the App that We believe may be of interest to You. If at any time You decide that You do not wish to receive such messages, You can disable them by writing to us, but in this case, We cannot guarantee that You will fully enjoy our Services.

“AMAN” is not responsible for the quality, Content, nature, or accuracy of any other website or application that can be accessed through any link on the App or sites linked to it, whether directly or indirectly. As these sites are not under our control, We are not responsible for the Contents of any other site or application linked to “AMAN” or any link in any site/application related to it, or any browsing page or any changes and updates to which these sites are subject. Please contact the external site or application administrator directly if there is any problem with the link.

Enforceability

The invalidity or unenforceability of any Clause of this Agreement shall not affect the validity or enforceability of any other Clause. Any invalid or unenforceable Clause shall be severed from this Agreement to the extent of its invalidity or unenforceability, and this Agreement shall be construed and enforced as if the Agreement did not include such a particular Clause to the extent of its invalidity or unenforceability.

The invalidity or unenforceability of other terms or conditions of this Agreement shall not affect any other Clause of this Agreement and if applicable, any unenforceable Clause hereof shall be amended to reflect the original intent of the parties.

If any Term or Clause of this Agreement is deemed by a court of competent jurisdiction to be invalid, illegal, or unenforceable, it shall not affect other or all Terms or Clauses hereof, but such Term or Clause shall be amended to the extent necessary in the opinion of the court to make such Term or Clause enforceable, and shall interpret and apply the rights and obligations of the parties accordingly, preserving to the fullest extent permissible the intentions and agreements of the parties herein.

Amendments

We are entitled at any time to make any amendments or updates that We deem necessary to “AMAN” App to increase its effectiveness, and the User is bound by any directions or instructions provided by the App in this regard.

We reserve the right at any time and at our absolute discretion to review these Terms of Use “Terms and Conditions” by amending or changing any/each of these Terms. Every time You wish to use the “AMAN” App, You shall periodically review these Terms of Use and to ensure that You understand the Terms that apply at that time, and Your continued use of the “AMAN” App implies Your acceptance of the Terms and Conditions applicable at the time of Your use of the App.

Indemnity

You acknowledge and agree to indemnify, defend, and not to subject AMAN, its owner, parent company, affiliates, partners, officers, directors, agents, contractors, licensors, Service Providers and employees, to any claim or demand, and they are exempt from any damages or responsibility for all claims, liabilities, losses, harm, costs, and expenses including legal fees arising from any breach or violation of these Terms and Conditions by You or other damages arising from Your use of “AMAN” App.

Indemnify “AMAN” for any losses, damages or harm resulting from the misuse of the rental products (whether wheelchairs or any of the products rented via the App)

Termination

Termination by “AMAN”: We reserve the right, at our sole discretion, to terminate, restrict or stop any User from accessing or using the App without notice and for any reason without giving any justification, or any behavior that the Administration of “AMAN” may consider illegal or harmful to others, including, without limitation, if We reasonably believe that You have violated the Usage Policy or any other relevant policy, or that You pose a risk or expose us to potential legal risks.

Termination by You: If You are not satisfied with the “SUPER” App, please let us know by sending an email to the email shown below. Your solution is to stop using the App.

The Entire Agreement

The Terms of Service and any policies or operating rules posted by us on this App or in connection with the Service constitute the entire Agreement and understanding between You as a User and AMAN which governs Your use of the Service and supersedes any prior agreements with respect to the subject matter of this Agreement, whether written or oral.

In the event that We are unable to implement any right or Article of these Terms of Service, this shall not be considered a waiver by us.

In the event that any Clause of this Agreement is considered to be illegal, invalid or unenforceable, in whole or in part, under any law, such provision or part of it shall not, to the extent that such provision or part thereof shall not form part of this Agreement, without affecting the legality, validity, and enforceability of other provisions of this Agreement.

Applicable Law and Dispute Resolution

This Agreement shall govern the “Terms and Conditions” and any disputes, claims, or controversies arising from or related to any violation thereof, termination, execution, interpretation, validity or use of the App or the Service, of the laws and regulations in force and valid in the Kingdom of Saudi Arabia.

You are not one of those who have previously benefited from “AMAN” Services, or you have been restricted or banned from using the App.

We are entitled to freeze or cancel the offending Accounts without any liability if we have reason to suspect that you have registered at the same time or control two or more Accounts.

You agree that all activities that occur under your Account are authorized by You and of Your own volition and that You are responsible for any risks arising from the use of these types of Services and that You provide us with all the papers required to prove Your identity.
